Facebook gets OK to expand its headquarters

A Silicon Valley city where Facebook has opened its new headquarters voted Tuesday to support an environmental impact report and development agreement for a project that will allow the social media giant to employ thousands more people at the campus.

Under the deal, Facebook could base about 6,600 workers at the sprawling headquarters in Menlo Park, up from the current limit of 3,600 employees that was placed on the campus' previous occupant, Sun Microsystems. Facebook moved its headquarters to the campus from Palo Alto last year and now has about 2,200 employees at the site.

In exchange, Facebook will pay the city an average of $850,000 a year over 10 years to cover the impact of the additional workers on city infrastructure. Facebook also will make a one-time payment of more than $1 million for capital improvements, establish a $500,000 community improvement fund and set up high school internship and job training programs.

Facebook eventually wants to expand to another campus across the street that would allow it to employ a total of 9,400 people. The company plans to construct five new buildings totaling approximately 440,000 square feet as part of that project, which was included in the environmental impact report approved Tuesday.

All five members of the Menlo Park City Council voted yes at the lengthy meeting Tuesday night.

"Welcome to Menlo Park and we're happy to have you here," Mayor Kirsten Keith told company representatives.

Facebook's plans have raised concerns about traffic among some residents who live in the company's shadow. The neighboring city of Atherton has threatened a lawsuit, saying the environmental impact report doesn't adequately address an expected increase in traffic at one particular intersection.

Menlo Park City Manager Alex McIntyre said the two cities are continuing to discuss the issue. Facebook has said it will encourage employees to carpool, take public transit or walk or bike to work.

Tuesday's vote will have to be seconded by the city council next week before it could go into effect, McIntyre said.

Violence flares after Egypt election results

CAIRO (AP) ? A mob set fire late Monday to the campaign headquarters of one of the two Egyptian presidential politicians facing each other in a runoff that will decide a new leader after last year's popular uprising, the first sign of unrest after the voting yielded divisive candidates.

The attack on Ahmed Shafiq's office came just hours after the country's election commission announced that he would face the Muslim Brotherhood's candidate, Mohammed Morsi, in a June 16-17 runoff.

The second round pitting Shafiq, who was ousted President Hosni Mubarak's last prime minister, against Morsi, backed by the country's most powerful Islamist movement, is a nightmare scenario for the thousands of Egyptians who took to the streets last year to demand regime change, freedom and social equality.

Many of the so-called revolutionaries say they want neither a return to the old regime nor religious rule.

"The choice can't be between a religious state and an autocratic state. Then we have done nothing," said Ahmed Bassiouni, 35, who was sitting in Cairo's downtown Tahrir Square in the midst of a growing protest.

In an upscale neighborhood of Cairo, mobs of young men used bricks to smash the windows of Shafiq's headquarters, tossing out campaign signs and tearing up his posters. Then they set fire to the building. There were no reports of injuries. Police arrested eight people.

His campaign blamed supporters of leftist candidate Hamdeen Sabahi, who came in third in the race, and backers of another losing candidate, Khaled Ali, who was protesting the election results Monday evening in Tahrir Square, the center of last year's uprising.

Shafiq, also a former air force commander, was forced out of office as prime minister by protesters shortly after Mubarak's fall. He has since presented himself as a figure who can restore calm to a country wracked by 15 months of sometimes violent protests and deterioration in internal security. He has expressed a zero-tolerance attitude toward protests, reflecting his background in the military and in the former regime, which put down protests with brutal force and jailed opponents.

Shortly after the protesters ransacked the campaign office, fire trucks and police arrived as several hundred of Shafiq's supporters gathered outside the building, carrying his picture and chanting slogans against the Muslim Brotherhood, which controls the parliament and is now seeking the presidency.

"The Brotherhood are enemies of God!," chanted the crowd.

The Morsi-Shafiq runoff is a polarizing contest. It mirrors the conflict between Mubarak, himself a career air force officer like Shafiq, and the Islamists he jailed and tortured throughout his years in power. But it sidelines the mostly young, secular activists who led the popular uprising last year.

The commission reported Monday that Morsi won close to 5.8 million votes, or almost 25 percent, while Shafiq received 5.5 million votes, or nearly 24 percent. Sabahi, a socialist, finished third with 4.8 million votes, or about 21 percent. Fourth place went to moderate Islamist Abdel-Moneim Abolfotoh. Turnout was about 50 percent.

In Tahrir Square, several thousands protesters chanted slogans against the military rulers who took over after Mubarak's ouster. Protesters have clashed frequently with the military in street protests that have killed more than 100 people, charging that the military is perpetuating the repressive practices of the Mubarak regime and bungling the transition to a new, elected government.

Protesters also chanted slogans against both Morsi and Shafiq, saying they will not allow Egypt to be ruled by one party again nor allow the former regime to regain power.

"Freedom! Freedom!" the crowds chanted, fists pumping in the air.

Some were demanding that a law approved by parliament banning former high-level regime officials from running in the election be implemented. That could apply to Shafiq. Egypt's Constitutional Court is set to look at the law just four days before the runoff.

Others charge that last week's election, with 13 candidates, was rigged, though observers said the vote was generally free.

In the Mediterranean port city of Alexandria, where Sabahi, a favorite among many revolutionaries, won the most votes, protesters tore down and burned large Shafiq and Morsi posters and protested against military rule.

In the Nile Delta provinces of Dakahliya and Mansoura, protesters took to the streets in similar protests. Security officials said protesters in Mansoura tried to attack the campaign offices of Morsi and Shafiq, but supporters of both candidates stopped the crowd.

The protests come just one day after Sabahi and Abolfotoh, whose supporters backed the popular uprising, filed appeals to the election commission to delay announcing the first round results until allegations of voter fraud could be investigated. Their appeals were rejected Monday.

Speaking to reporters Monday, Abolfotoh said "violations threatened the integrity of the election."

"It is impossible under any circumstances for me to say with a national conscience that these elections were clean," Abolfotoh said.

Facebook investors could recoup losses in court

CNBC's Jane Wells talks to people in Silicon Valley to get their take on Facebook's IPO and its impact on future IPOs.

Retail investors with dreams of instant wealth who bought Facebook shares on opening day may have been disappointed, but they could still wind up with a windfall if lawyers seeking class-action status for lawsuits against the company and its IPO underwriters get their way.

A pair of lawsuits filed in New York and California allege that retail investors were harmed when material information about the company's finances weren't disclosed to them. ?

Experts in securities law have said whether or not plaintiffs will be able to recoup their trading floor losses in a courtroom will depend on the fine print of securities regulations.?What Facebook and its underwriters, including primary underwriter Morgan Stanley, which declined to comment on the suits, knew, and when and to whom they provided information, are the issues on which both lawyers and regulators are focusing.

"It sounds like this is where that case is going to be one of the battlefields," said?David Buckner, a partner at law firm Grossman Roth P.A., whose expertise is in class action suits and securities litigation. "Who has an obligation to speak to who ? that's something that will end up being important."?

Following a Congressional hearing on Tuesday, Securities and Exchange Commission chair Mary Schapiro said, "I think there is a lot of reason to have confidence in our markets and in the integrity of how they operate, but there are issues that we need to look at specifically with respect to Facebook."

Facebook did warn would-be investors of potential challenges to its revenue stream triggered by an increase in mobile users and Facebook's still-poor ability to monetize its mobile base. In an uncharacteristic amendment to its S.E.C. filing just over a week before its IPO, the company warned that these factors had the ability to hurt profits.?

Investors who feel burned and are pursuing legal action contend that the company's cautionary statements weren't specific enough, that Facebook knew that this issue was having more of a negative impact than it let on in the filing, and it tipped its hand only to its underwriters and a handful of analysts.?

"The real issue is how adequate a warning was the May 9 registration statement language," said?Merritt B. Fox, law professor at Columbia University. "Without?knowing the facts, it's hard to know if what the analysts were doing was simply interpreting information that was in the May 9 statement or whether they had additional information to suggest that things were worse."

The Wall Street Journal cited unnamed sources saying Facebook executives contacted nearly two dozen analysts following that amendment and let them ask questions about it. The lawsuits assert that this communication amounted to material information which Facebook, which has said it will defend itself "vigorously," was legally obligated to share with all investors.

"It wasn't the prospect" of future losses, said?David Rosenfeld, an attorney at Robbins Geller Rudman & Dowd, a law firm representing plaintiffs in a suit filed in U.S. District Court in Manhattan on Wednesday.?"They already knew? and they told their underwriters," he said.

The Public Speaking Mindset

This article is Part 1 in a 3-part series on A?Smart Presentation and Public Speaking Skills

Before you read any of the other articles in the series, read this one first!

I can?t overemphasize the importance of the right public speaking and presentation mindset. ?I emphasize this because mindset is the only?way to learn to speak and present well. ?Thinking about and understanding?what makes a speech good or bad makes it easy to take the action needed (e.g. hand gestures, tone inflection, etc.) to give a spectacular presentation.

That?s completely different from the way most teach public speaking.

As I mentioned in the introduction to the series, public speaking and presentations are situational. ?It?s not a math equation, where you succeed by memorizing variables and processes. ?Being able to speak and present well means:

- Being able to think on your feet.

-Adapting what you have to say to the situation (e.g. the audience, the atmosphere, the size of the room, etc.).

- Coming across as confident?and making your message count?no matter what the situation.

Before learning the Public Speaking Mindset, understand a couple things about why you fear public speaking, and what you can do about it:

You probably fear public speaking because?it is situational and lacks a specific structure.

Do you fear public speaking for any of these reasons:

a.) What do I do if I get heckled by a member of the audience?

b.) How do I know if the information I?m presenting is what the audience wants to hear?

c.) What if I?m boring?

d.) What if I screw up?

If public speaking had a specific structure, there?s no way?you could fear any of these things: just like a math equation; you?d memorize how to say what, how to say it, and then give a great speech.

But think about it: how can you know what will happen during your presentation? ?How do you know your audience?s reaction? ?You won?t know for sure until you get there. ?Public speakers who accept speaking for what it is?a situational, fluid process?can get over silly ways to purportedly master public speaking (reading ?tips?) and get onto more useful techniques.

The only?way to improve your speaking abilities is through habit formation.? That comes only?with?practice.

Not?through reading books. ?Not?through reading my blog articles. ?Not?through talking about it with friends.

I think some will say ?that sucks! ?I?m not going out there to try to give a speech without knowing what I?m doing first!?

When I give a speech, it just happens. ?The speed at which I talk, the way I move my hands, the way I make eye contact, my tone inflections?I think about exactly none of it?when I?m talking.

I can do that because I?ve practiced like hell. ?It?s just a habit.

I recently gave a speech about an equity valuation my team and I did on a company. ?Half way through the speech, I offered to sell our ?patented? valuation model to the professor, or exchange it for a better grade. ?The audience broke out laughing! ?The professor?who usually never showed emotion?cracked a smile.

I hadn?t planned for that at all. ?It just seemed like the thing to say. ?And I was right; I think ours was the best speech of the 10 that were given that evening.

Think of trying to master public speaking through tip memorization like grocery shopping with a long grocery list, except that you don?t get to bring the list with you.

?What am I supposed to buy? ?Let?s see: milk, salad, ham, oatmeal, prunes (maybe I won?t get those)??. ?You?re trying to juggle a million different things in your mind at once.

What happens when you get home?

?Crap, I forgot the vanilla wafers!?

The same concept applies to tip memorization during speeches. ?How do you think you?re going to be able to juggle a million different tips in your mind at once?

You can?t.

But through practice, you convert an idea into a habit. ?

So let?s talk about that now.

What is the Public Speaking Mindset? ?

The Public Speaking Mindset

1. Understand your purpose and your value-added.

Before you say ?duh, I need to know what I?m giving my speech on?, read the rest of what I have to say here.

Your purpose is more than your topic. ? Understanding your purpose is the bedrock?and guiding light?for forming a presentation that is relevant, engaging and inspiring. ?Think about it:

- How many times have you listened to a speech where the speaker rambled on, and it was unclear what his main point was?

-How about presentation slides? ?Ever seen any with way too much writing?

Before you even start writing your speech, you should ask yourself, ?Of all of the things I could say about my topic, which are value-added??. ?Then, only?talk about those things that are value-added.

A perfect example:

In my Masters of Taxation program, everyone in the class was required to give a presentation about a complicated tax issue. ?How do you think most of my classmates gave them?

-They would repeat each and every fact about the case (often a 10 page court case).

-They would cover almost every facet of a large Internal Revenue Code section or regulation.

-They would give an extensive analysis with each line being something like this: ??According to Treas. Reg. ? 1.213-1(e)(1)(v), the cost of an in-patient hospital care is an expenditure for medical care, however for the institutions other than a hospital, the qualifications depend on the condition of the individual and the nature of the services he receives.?

Imagine having to listen to these presentations. ?The thing I realized from sitting through 40 of these is just how bad a speech is if the presenter isn?t focused on staying on point and conveying only value-added information.

It?s important for the speaker to know what aspects?of his or her topic to actually discuss!

The best way to do this: think first about your conclusion.

A lesson I learned long ago when I volunteered for some local political campaigns?:

The most people are going to remember about your speech is 2 or 3 things. ?So when you?re preparing your presentation, think to yourself- ?what are the 3 most important things I want my audience to remember? ?Focus your entire presentation around those 3 things?.

So- what is your bottom line? ?What is your conclusion? ?Whatever your ultimate point or punchline is: that?s what you should focus every word?of your speech on. ?Eliminate those words which add no value.

Think of the excerpt above that cites the Treasury Regulation. ?When you think about it, the actual value added here is knowing that care at a hospital will always count as a medical expense, but it will depend if it?s at something other than a hospital. ?The regulation citation and the faux-professional $10 words add nothing to the sentence?s basic meaning: it only adds complication.

So the next question naturally flows: how do I know what my conclusion?should be?

2. Understand your audience?s disposition.

-What does your audience already know?

-What do they want?to know?

-What kind of attention span do they have?

Way too many speeches I?ve heard simply exist for their own sake. ?The speaker just wants to?or has been forced to?talk about something random. ?And so they do just that; talk about whatever they want with minimal consideration to the audience.

But the real question is: ?what does your audience want??

3. You are an entertainer in addition to the main purpose of your speech.

I?m pretty sure I can, instead of listening to your speech:

a.) Go read a blog article

b.) Go read a Wikipedia article

c.) Go read a joke book,

and get the same content and ideas that I could from your speech.

But I?m taking time out of my day to listen to you.? Are you going to make it worth my while?

All of the aforementioned formats can convey the same content that your speech does. ?But can they convey the same feeling and emotion that your speech does?

I don?t necessarily mean ?be funny?; I mean ?be entertaining?.

Giant condor backs away from extinction, but lead poisoning threatens

One of the most endangered?birds in the world,?the California condor,?has crept back from the brink?of extinction?through a strenuous three-decade conservation effort. But conservationists say the giant bird can?t become a self-sufficient population in the wild again unless its habitat becomes free of lead ammunition used by hunters.

"It?s huge," said David Shepherdson, deputy conservation division manager at the Oregon Zoo, which has a condor breeding program. "Lead poisoning from lead ammunition is the one thing preventing them from becoming a self-sustaining, non-endangered ? wild population."

The California condor is the largest bird in North America, with a wingspan of up to 10 feet. Historically, the species' habitat ranged all the way from Baja, Mexico, to British Columbia, Canada. The mammoth bird, a type of vulture, can fly 150 miles a day.

The population of giant California condors in the wild fell so low in 1982 ? 22 birds ? that U.S. Fish and Wildlife made the controversial decision to capture them all for breeding programs.


The process has been?slow and painstaking. Condors typically lay just one egg every two years in the wild, and even in captivity they rarely have more than one offspring?a year. Then, if they survive, they live about the same length of time as humans.

With three decades of work breeding and reintroducing them in the wild, the California condor population had climbed to 405 in an April 30 census ? including more than 226 living in the wild, and another 179 living in zoos and four breeding centers, according to a report in The Oregonian, citing U.S. Fish and Wildlife officials.

But for condors, which are?scavengers that feed on dead animals and "gut piles" left behind by hunters that?contain fragments of lead bullets, lead poisoning is the leading cause of death. The poisoning?causes a slow death by starvation or weakens the birds, making them vulnerable to predators.

Condors were first reintroduced to the Vermilion Cliffs near the Arizona-Utah border in 1996 and that wild population now is around 60, flying through the Kaibab National Forest, Grand Canyon National Park and lands in Utah and Nevada.

Of those released in Arizona ? one of several reintroduction sites ? at least 22 have died of lead poisoning, and many others?have required treatment for lead poisoning through a process of "leeching" called kelation, said Kathy?Sullivan, a biologist who coordinates the condor program for Arizona Game and Fish.

In California, hunters are barred from using lead ammunition in areas designated condor habitat. The alternative ammunition is often more expensive and harder to find.

On Friday, several environmental groups issued a notice?of intent to sue the U.S. Forest Service under the Endangered Species Act for allowing the continued use of lead ammunition in the Kaibab National Forest, a key feeding area for condors released in Arizona.

Banning lead ammunition "isn't like some kind of radical idea," said Sandy Bahr, director for the Grand Canyon Chapter of the Sierra Club, one of the groups threatening to sue. "There has been a requirement for a pretty long time for hunters who are hunting water fowl to use non-lead ammunition. ? To get the manufacturers and widespread non-lead ammunition it has to be required.

"(The California condor) is a wonderful comeback story and illustration of how the Endangered Species Act works, and how a concerted effort by many interests can result in giving a species a second chance," said?Bahr of the Sierra Club, an environmental lobbying group. "But we can?t just sit back and breathe a sigh of relief."

Officials at Kaibab National Forest did not respond to calls for comment.

But Sullivan, the condor program coordinator for Arizona Game and Fish, said that the state has an effective voluntary program for hunters in Arizona built through education and outreach. Licences for deer hunting and other game are drawn by lottery, and the state actually provides free non-lead ammunition to those whose names are drawn. She said a portion of hunters, instead of changing ammunition, have agreed to remove "gut piles" to prevent lead poisoning of condors. In total, the state has at least 80 percent participation by hunters.

Sullivan said the continuing lead poisoning of Arizona-released condors appears to be because many are now flying into neighboring Utah where there is no such program to limit lead exposure.

"We have a pretty darn successful program in Arizona, but the birds have shifted up to Utah," said Sullivan. "In my opinion that?s where the efforts should be."

Worm-like robot climbs clothes with alacrity

Letting people climb walls like a bug is one thing, but letting robots climb humans like one??The researchers at the Chinese Academy of Science must have felt that robots these days just weren't creepy enough.

The Clothbot is a small robot that uses a pair of grippy wheels to climb up cloth?at an alarming rate, be it a lab coat, curtain or jeans. By twisting its head and moving its tail, it can change its center of gravity and the direction it climbs.

Watch this video, and try not to imagine it sliding up your back.

Its chief application seems to be sending shivers up viewers' spines, but the inventors mention several possibilities, as quoted at IEEE Spectrum's Automaton blog:

  • A tiny pet climbing on human bodies
  • A movable phone on our shoulder which frees human hands
  • Body inspection

Not particularly convincing. In fact, they're the kinds of applications robots might make up in order to justify this strange creature's existence. But there's no getting past the fact that, creepy or not, it's effective and interesting. Hopefully they'll find a way to use it that doesn't involve it climbing up my leg.

Facebook's IPO one of world's largest

NEW YORK (AP) ? In one of the largest initial public offerings of stock ever, Facebook said Thursday that it is raising at least $16 billion for itself and its early investors in a transaction that values the world's definitive online social network at $104 billion.

It's a big windfall for a company that began eight years ago with no way to make money.

Facebook priced its IPO at $38 per share on Thursday, at the top of expectations. The company is selling just a portion of its shares as part of the offering. The $38 price means all of its shares will be worth about $104 billion, giving the company a market value higher than Amazon.com and other well-known companies such as Kraft, Disney and McDonald's.

Facebook's stock is expected to begin trading on the Nasdaq Stock Market sometime Friday morning under the ticker symbol "FB." That's when so-called retail investors can try to buy the stock.

Facebook's offering is the culmination of a year's worth of Internet IPOs that began last May with LinkedIn Corp. Since then, a steady stream of startups focused on the social side of the Web has gone public, with varying degrees of success. It all led up to Facebook, the company that's come to define social networking by getting 900 million people around the world to share everything from photos of their pets to their deepest thoughts.

It has done so while managing to become one of the few profitable Internet companies to go public recently. It had net income of $205 million in the first three months of 2012, on revenue of $1.06 billion. In all of 2011, it earned $1 billion, up from $606 million a year earlier. That's a far cry from 2007, when it posted a net loss of $138 million and revenue of $153 million.

"They could have gone public in 2009 at a much lower price," said Nick Einhorn, research analyst at IPO investment advisory firm Renaissance Capital. "They waited as long as they could to go public, so it makes sense that it's a very large offering."

Facebook Inc. is the third-highest valued company to go public, according to data from Dealogic, a financial data provider. Only two Chinese banks, Agricultural Bank of China in 2010 and Industrial and Commercial Bank of China in 2006, have been worth more. At $16 billion, the size of the IPO is the third-largest for a U.S. company. The largest U.S. IPO was Visa, which raised $17.9 billion in 2008. No. 2 was Enel, a power company and No. 4 was General Motors, according to Renaissance Capital.

For the company that was born in a Harvard dormitory and went on to reimagine online communication, the stock sale means more money to build on the features and services it offers users. It means an infusion of funds to hire the best engineers to work at its sprawling Menlo Park, Calif., headquarters, or in New York City, where it opened an engineering office last year.

And it means early investors, who took a chance seeding the young social network with start-up funds six, seven and eight years ago, can reap big rewards. Peter Thiel, the venture capitalist who sits on Facebook's board of directors, invested $500,000 in the company back in 2004. He's selling nearly 17 million of his shares in the IPO, which means he'll get some $640 million.

The offering values Facebook, whose 2011 revenue was $3.7 billion, at as much as $104 billion. The sky-high valuation has its skeptics, who worry about signs of a slowdown and Facebook's ability to grow in the mobile space when it was created with desktop computers in mind. Rival Google Inc., whose revenue stood at $38 billion last year, has a market capitalization of $207 billion.

"There seems to be somewhat of a hype around the stock offering," says Gartner analyst Brian Blau.

That, of course, is an understatement.

Facebook's IPO dominated media coverage in the weeks and days leading up to the event. Zuckerberg's hoodie made headlines as did General Motors' decision to stop advertising on the site ?and rival Ford's affirmation that its Facebook ads have been effective.

There are a few reasons for the exuberance. First, there's Facebook's sheer size and high profile. The company grew from a college-only social network to an Internet phenomenon embraced by legions of people, from teenagers to grandmothers to pro-democracy activists in the Middle East.

Secondly, it's personal.

"It's probably one of the first times there has been an IPO where everyone sort of has a stake in the outcome," Blau says. While most Facebook users won't see a penny from the offering, they are all intimately familiar with the company, so it resonates as something they understand.

And then there's CEO Mark Zuckerberg, who turned 28 on Monday. He has emerged as the latest in a lineage of Silicon Valley prodigies who are alternately hailed for pushing the world in new directions and reviled for overstepping their bounds. He counted the late Apple CEO Steve Jobs among his mentors and he became one of the world's youngest billionaires ? at least on paper ? well before Facebook went public. A dramatized version of Facebook's founding was the subject of a Hollywood movie that won three Academy Awards last year, propelling Zuckerberg even further into the public spotlight.

Though Zuckerberg is selling about 30 million shares, he will remain Facebook's largest shareholder. Even after the IPO, he will own 503.6 million shares, or 32 percent of Facebook's total shares. At the $38 share price, his stake in the company is worth $19.1 billion. Zuckerberg will control the company with 56 percent of its voting stock as a result of agreements he has with other shareholders who promise to vote his way.

The set-up helps to ensure that he and other executives keep control as the sometimes conflicting demands of Wall Street exert new pressures on the company.

True to form, Zuckerberg and Facebook's engineers are ringing in the IPO on their own terms. The company is holding an overnight "hackathon" Thursday, where engineers stay up writing programming code to come up with new features for the site. On Friday morning, Zuckerberg will ring the Nasdaq opening bell from Facebook's headquarters.

The $38 share price is the price at which the investment banks arranging the offering will sell the stock to their clients. If extra shares reserved to cover additional demand are sold as part of the transaction, Facebook Inc. and its early investors stand to reap as much as $18.4 billion from the offering.
