Hackers use alert system for zombie warnings

DETROIT (AP) ? Warnings about the zombie apocalypse may seem pretty amusing, but officials say they're dead serious about figuring out who hacked into the nation's public warning system to broadcast such messages in a handful of states.

So far, people in California Michigan, Montana and New Mexico have heard the warnings about attacking zombies that have been sent over the Emergency Alert System.

"Local authorities in your area have reported the bodies of the dead are rising from their graves and attacking the living," the message warned. "Do not attempt to approach or apprehend these bodies as they are considered extremely dangerous."

The subject matter may be humorous, but Greg MacDonald with the Montana Broadcasters Association said the consequences of such attacks on the alert system could be severe.

"This looks like somebody being a prankster, but maybe it's somebody testing just to see if they could do this, to do some real damage," MacDonald said. "Suddenly you create a panic and people are fleeing somewhere and you end up with traffic jams and accidents and who knows what."

The U.S. recently replaced its old telephone-based alert system with a web-based one. The Federal Communications Commission sent an urgent advisory Tuesday urging stations to reset their alert system passwords, disconnect their Internet connections and take other steps to make sure the equipment is protected from outside attack.

In Michigan, hackers broke into the system with audio or text messages at two stations on Monday. Michigan Association of Broadcasters President Karole White said the breach appeared to be related to default passwords that the stations hadn't changed. The U.S. recently replaced its old telephone-based alert system with a web-based one.

In Los Angeles, a radio station that had its alert system breached sent out a zombie message, according to Richard Rudman, a broadcast engineer and vice chair of the California State Emergency Communications Committee. He declined to name the station but said any that were hacked were using default passwords for their alert systems or lacked adequate computer security.

The FCC on Tuesday also asked stations to check their equipment to make sure no further unauthorized alerts were queued up for future transmission, according to a copy of the advisory provided by the Montana Broadcasters Association.

No one has been arrested in connection with the hacking incidents.

All U.S. broadcasters are required to be part of the Emergency Alert System, which evolved from Cold War-era systems dating to the 1950s and '60s. The system was created so the president could address the public in a national emergency, but it's mainly used by state and local authorities to deliver weather warnings and Amber Alerts. The first national test of the revamped system was in November 2011.

WNMU in the northern Michigan city of Marquette was broadcasting an episode of "Barney and Friends" just before 4 p.m. Monday when an ominous voice warned of zombies on the loose. The station quickly caught the errant message and disabled the system.

"There were really no complaints," said station general manager Eric Smith. "A couple of viewers ... called, wondering what it was all about."

Michigan FBI spokesman Simon Shaykhet said his office has been notified but declined further comment. The Associated Press left messages with representatives of the Federal Communications Commission and Department of Homeland Security.

The Federal Emergency Management Agency said its public alert and warning system wasn't breached and the hacking incidents did not affect its ability to activate the system nationally. FEMA also said it's supporting the FCC and other federal agencies on the investigation.

White, who oversees the alert system in Michigan, says she's confident that systems there are now secure, though any breach is a concern.

"We feel fortunate they were not able to get into the entire Emergency Alert System ? that's the good news," she said. "The bad news is they got in at all."

Verizon's Droid DNA to be updated with bug fixes

Verizon's HTC-built Droid DNA will soon be receiving a software update with a few important bug fixes, as the carrier has just posted word on its Droid DNA software support page. The new version 2.04.605.2 710RD comes with a sizeable changelog, including references to fixes for the mobile hotspot function, headset audio quality and Bluetooth --

  • User can load videos on HuluPlus
  • Improvements to Hotspot connectivity have been made
  • Improvements to Audio Quality for wired headsets and earpieces have been made
  • Bluetooth connectivity and volume level for specific models have been improved
  • Enhanced reliability and stability of the Contacts List have been made

We've had first-hand experience of mobile hotspot jankiness on the DNA, so hopefully this update will provide relief for this and other lingering issues with the phone. If previous Verizon updates are any indication, this new DNA firmware should start pushing out in the days ahead. When it does, the update file will weigh in at 103.5MB.

EA Launches Origin Online Game Distribution for Mac - Mac Rumors

A Mac client for EA's digital distribution platform Origin was launched today, as first noted by AppleInsider. Origin for Mac was originally announced in August 2011 and went into alpha testing in late January.?

Origin is quite similar to Valve's Steam and allows users to download games and demos, chat with friends and continue saved games from most computers.

The store currently lists 48 Mac games available for download, including games like Batman: Arkham City Game of the Year Edition, LEGO Batman, Harry Potter and Star Wars, Tropico 3: Gold Edition and The Sims 3 and its plethora of expansion packs.?The new SimCity is supposed to launch a little after the March release of the PC version of the game.

EA Origin Vice President of Production Mike Blank told AppleInsider that EA brought Origin to Mac because of two reasons: growing Mac marketshare and a vocal community of Mac gamers.

"We're seeing increased activity from our Mac gamers," he said. "In the past, we've brought games slower to market for Mac than for PC partly because the audience hasn't been at the same level. The growth of iOS and Mac devices, though, means we're starting to see gamers demand to play their games on devices that are becoming more prominent. I think, across the board, developers have focused on the PC platform, but I think you're going to start seeing some changes there. [Origin] is the first step in a strategy you're going to start seeing coming out of EA."
Origin client for Mac is available as a download for free at EA's Origin website. It requires OS X 10.6.8 or higher and an Intel Core 2 Duo Processor.

Venezuela devalues its currency by nearly half

CARACAS, Venezuela (AP) ? Venezuela's government announced Friday that it is devaluing the country's currency, a long-anticipated change expected to push up prices in the heavily import-reliant economy.

Officials said the fixed exchange rate is changing from 4.30 bolivars to the dollar to 6.30 bolivars to the dollar.

The devaluation had been widely expected by analysts in recent months, though experts had been unsure about whether the government would act while President Hugo Chavez remained out of sight in Cuba recovering from cancer surgery.

It was the first devaluation to be announced by Chavez's government since 2010, and it brought down the official value of the bolivar by 46.5 percent against the dollar. By boosting the bolivar value of Venezuela's dollar-denominated oil sales, the change is expected to help alleviate a difficult budget outlook for the government, which has turned increasingly to borrowing to meet its spending obligations.

Planning and Finance Minister Jorge Giordani said the new rate will take effect Wednesday, after the two-day holiday of Carnival. He said the old rate would still be allowed for some transactions that already were approved by the state currency agency.

Venezuela's government has had strict currency exchange controls since 2003 and maintains a fixed, government-set exchange rate. Under the controls, people and businesses must apply to a government currency agency to receive dollars at the official rate to import goods, pay for travel or cover other obligations.

While those controls have restricted the amounts of dollars available at the official rate, an illegal black market has flourished and the value of the bolivar has recently been eroding. In black market street trading, dollars have recently been selling for more than four times the official exchange rate of 4.30 bolivars to the dollar.

The announcement came after the country's Central Bank said annual inflation rose to 22.2 percent in January, up from 20.1 percent at the end of 2012.

The oil-exporting country, a member of OPEC, has consistently had Latin America's highest officially acknowledged inflation rates in recent years. Spiraling prices have come amid worsening shortages of some staple foods, such as cornmeal, chicken and sugar.

Seeking to confront such shortages, the government last week announced plans to have the state oil company turn over more of its earnings in dollars to the Central Bank while reducing the amount injected into a fund used for various government programs and public works projects.

It was the fifth time that Chavez's government has devalued the currency since establishing the currency exchange controls a decade ago in an attempt to combat capital flight.

Giordani said at a news conference that the government also decided to do away with a second-tier rate that has hovered around 5.30 bolivars to the dollar, through a bond market administered by the Central Bank. That rate had been granted to some businesses that hadn't been able to obtain dollars at the official rate.

Central Bank President Nelson Merentes called that bond trading system, known by the acronym Sitme, "imperfect."

"It doesn't make much sense to keep a system that seeks the country's debt to feed it," Merentes said.

The government's announcement drew strong criticism from opposition leader Henrique Capriles, who said that the government's heavy spending was to blame for the situation and that officials were trying to slip the change past the public at the start of a long holiday weekend.

"They spent the money on campaigning, corruption, gifts abroad!" Capriles said in one of several messages on his Twitter account.

Capriles criticized Vice President Nicolas Maduro's handling of the situation. Maduro, who was named by Chavez as his preferred successor before undergoing cancer surgery Dec. 11, has taken on more responsibilities and a higher profile during the president's nearly two-month absence.

"They give Mr. Maduro a little more time in charge and he finishes with the country," Capriles said. "Look at the inflation in January, and now the devaluation."

U.S. judge dismisses Iraq lawsuit over U.N. program

(Reuters) - A U.S. judge on Wednesday dismissed Iraq's lawsuit accusing a variety of companies that transacted with the country when it was led by Saddam Hussein of conspiring with his regime to frustrate the United Nations' oil-for-food program.

U.S. District Judge Sidney Stein in Manhattan said that as a matter of law, conduct by the Hussein regime is attributable to the current Iraq government.

"The court rejects Iraq's view that it may sidestep responsibility because the conduct was illegal or the actors held power illegitimately," he wrote.

The U.N. program let Iraq sell oil to finance the purchase of tens of billions of dollars of food, medicine and other goods for citizens hurt by international trade sanctions.

Legal argument for drone strikes on Americans

A confidential Justice Department memo concludes that the U.S. government can order the killing of American citizens if they are believed to be ?senior operational leaders??of al-Qaida or ?an associated force? -- even if there is no?intelligence?indicating they?are?engaged in an active plot to attack the U.S.

The 16-page memo, a copy of which was obtained?by NBC News, provides new details?about the legal reasoning behind one of the Obama administration?s most secretive and controversial polices: its dramatically increased use of drone strikes against al-Qaida suspects, including those aimed at American citizens, such as the? September 2011 strike in Yemen that killed alleged al-Qaida operatives Anwar al-Awlaki and Samir Khan. Both were U.S. citizens who had never?been indicted by the U.S. government nor charged with any crimes.??

The secrecy surrounding such strikes is fast emerging as a central issue in this week?s hearing of White House counterterrorism adviser John Brennan, a key architect of the drone campaign, to be CIA director.??Brennan was the first administration official to publicly acknowledge drone strikes in a speech last year, calling them ?consistent with the inherent right of self-defense.? In a separate talk at the Northwestern University Law School in March, Attorney General Eric Holder?specifically endorsed the constitutionality of?targeted killings of Americans, saying they could be justified if government officials determine the target?poses? ?an imminent threat of violent attack.?


But the confidential?Justice Department ?white paper??introduces a more expansive definition of self-defense or imminent attack than described? by Brennan or Holder in their public speeches.? It refers, for example,?to what it calls a ?broader concept of imminence? than actual intelligence about any ongoing plot against the U.S. homeland. ? ?

?The condition that an operational? leader present an ?imminent? threat of violent attack against the United States does not require the United States to have clear evidence that a specific attack on U.S. persons and interests will take place in the immediate future,? the memo states.

Instead, it says,? an ?informed, high-level? official of the U.S. government may determine that the targeted American? has been ?recently? involved in ?activities? posing a threat of a violent attack and ?there is? no evidence suggesting that he has renounced or abandoned such activities.? The memo does not define ?recently? or ?activities.??

As in Holder?s speech, the confidential?memo lays out a three-part test that would make targeted killings of American lawful: ?In addition to the suspect being an imminent threat, capture of the target must be ?infeasible, and the strike must be conducted according to ?law of war principles.? But the memo elaborates on some of these factors in ways that go beyond what the attorney general said publicly. For example, it states that U.S. officials may consider whether an attempted capture of a suspect? would?pose an ?undue risk? to U.S. personnel involved in such an operation. If so, U.S. officials could determine that the capture operation of the targeted American would not be feasible, making it lawful for the U.S. government to order a killing instead, the memo concludes.

The?undated?memo is entitled ?Lawfulness of a Lethal Operation Directed Against a U.S. Citizen who is a Senior Operational Leader of Al Qa?ida or An Associated Force.?? It was provided to members of the Senate Intelligence and Judiciary committees?in June by administration officials on the condition that it be kept confidential and? not discussed publicly.

Although not an official legal memo, the white paper was represented by administration? officials as a policy document that closely?mirrors the arguments of classified memos on targeted killings by the Justice Department?s? Office of Legal Counsel, which provides authoritative legal advice to the president and all executive branch agencies. The administration has refused to turn over to Congress or release those memos publicly -- or even publicly confirm their existence. A source with access to the white paper, which is not classified,?provided a copy to NBC News.?

?This is a chilling document,? said Jameel Jaffer, deputy legal director of the ACLU, which has sued unsuccessfully in court to obtain administration memos about the targeted killing of Americans.? ?Basically, it argues that the government has the right to carry out the extrajudicial killing of an American citizen. ? It recognizes some limits on the authority it sets out, but the limits are elastic and vaguely defined, and it?s easy to see how they could be manipulated.?

In particular, Jaffer said, the memo ?redefines?the word imminence in a way that deprives the word of its ordinary meaning.???

A Justice Department spokeswoman declined to comment on the white paper. The spokeswoman, Tracy Schmaler, instead pointed to public speeches by what she called a ?parade? of administration officials, including Brennan, Holder, former State Department Legal Adviser Harold Koh and former Defense Department General Counsel Jeh Johnson that she said outlined the ?legal framework? for such operations.?

Pressure for turning over the Justice Department memos on targeted killings?of Americans appears to be building on Capitol Hill amid?signs that Brennan will be grilled on the subject at his confirmation hearing before the Senate Intelligence Committee on Thursday.?

On Monday, a bipartisan group of 11 senators -- led by Democrat Ron Wyden of Oregon ? wrote? a letter to President Barack Obama asking him to release all Justice Department memos on the subject.?While accepting that ?there will clearly be circumstances in which the president has the authority to use lethal force? against Americans who take up arms against the country, ?it said, ?It is vitally important ... for Congress and the American public to have a full understanding of how? the executive branch interprets the limits and boundaries of this authority.?

Anticipating domestic boom, colleges rev up drone piloting programs

The completeness of the administration?s public accounts of its legal arguments was also sharply criticized last month by U.S. Judge Colleen McMahon in response to a? lawsuit brought by the New York Times and the ACLU seeking access to the Justice Department memos on drone strikes targeting Americans under the Freedom of Information Act.? McMahon, describing herself as being caught in a ?veritable Catch-22,?? said she was unable to order the release of the documents given ?the thicket of laws and precedents that effectively allow the executive branch of our government to proclaim as perfectly lawful certain actions that seem on their face incompatible with our Constitution and laws while keeping the reasons for the conclusion a secret.?

In her ruling, McMahon noted that administration officials ?had engaged in public discussion of the legality of targeted killing, even of citizens.? But, she wrote, they have done so ?in cryptic and imprecise ways, generally without citing ? any statute or court decision that justifies its conclusions.?

In one passage in Holder?s speech at Northwestern in March,? he alluded ? without spelling out?that there might be circumstances where the president might order attacks against American citizens without specific knowledge of when or where an attack against the U.S. might take place.

?The Constitution does not? require the president to delay action until some theoretical end-stage of planning, when the precise time, place and manner of an attack become clear,?? he said.

But his speech did not contain the additional language in the white paper suggesting that?no active intelligence about a specific attack is needed?to justify a targeted strike. Similarly, Holder said in his speech that targeted killings of Americans can be justified? if ?capture is not feasible.? But he did not include language in the white paper saying that an operation might not be feasible ?if it could not be physically effectuated during the relevant window of opportunity or?if the relevant country (where the target is located) were to decline to consent to a capture operation.? The speech also made no reference to the risk that might be posed to U.S. forces seeking to capture a target, as was ?mentioned in the white paper.?

The white paper also includes a more extensive discussion of why targeted strikes against Americans does not violate constitutional protections afforded American citizens as well as?? a U.S. law that criminalizes the killing of U.S. nationals overseas.

It??also discusses why such targeted killings would not be a war crime or violate a U.S. executive order banning?assassinations.

??A lawful killing in self-defense is not an assassination,? the white paper reads. ?In the Department?s view, a lethal operation conducted against a U.S. citizen whose conduct poses an imminent threat of violent attack against the United States would be a legitimate act of national self-defense that would not violate the assassination ban. Similarly,? the use of lethal force, consistent with the laws of war, against an individual who is a legitimate military target would be lawful and would not violate the assassination ban.?

CeeLo, Kyle Bush, others party for Super Bowl

NEW ORLEANS (AP) ? CeeLo was looking for a little New Orleans action. David Gregory was taking the weekend off from "Meet the Press." And Paul McCartney was hanging out at a party that included Pitbull and Flo Rida.

It was a rich and eclectic mix of stars of all wattages on Friday night, as partying got under way in earnest before Sunday's big game.

CeeLo was the featured performer at ESPN Magazine's "Next" party, which had a guest list that included Michael Phelps, NASCAR driver Kyle Busch, Kelly Rowland, Anthony Mackie, Jeremy Piven, Josh Hutcherson, and current and former football players like Emmitt Smith, Cris Carter, DeSean Jackson.

CeeLo performed with his old rap clique Goodie Mobb: The group, which was an offshoot of OutKast before CeeLo became a solo hit, is coming out with a new album later this year. Though the ESPN party was the main event of his night, he made it clear it would not be his only one: "New Orleans has got a lot to offer, I may get into a little trouble."

The stars were spread out across New Orleans: McCartney gave a rock royalty air to the Rolling Stone party, which featured performances by Flo Rida and Pitbull and guests that included Chace Crawford and Sofia Vergara.

At Audi's Super Bowl lounge, Will Ferrell, Jeremy Renner and Olivia Munn mingled, and Playboy attracted Neil Patrick Harris, David Arquette and others. Back at the ESPN party, Gregory, a Redskins fan, admitted to playing hooky from his weekly political show for the big game.

"To get a chance to come to New Orleans on top of it all, it doesn't get much better than this. I love sports, I love the Super Bowl, so this is a great opportunity," said Gregory, who was rooting for the Ravens.

Mackie, an actor and New Orleans native, was excited to have the Super Bowl in his hometown once again, though he's still smarting that the Saints aren't in it; the team fared poorly this season after being hit with significant sanctions by NFL Commissioner Roger Goodell over allegations of bounty hits on opposing players.

When asked what he would say to Goodell if he saw him, Mackie said: "I'd tell him congratulations. What he wanted to happen happened, so now the saints are going to come back twice as hard next season."

Alan Cumming's 1-man 'Macbeth' heads to Broadway

NEW YORK (AP) ? Alan Cumming is taking his Macbeth to Broadway ? and his Macduff and Duncan and the three witches.

Producers said Friday that the Tony Award winning Scottish actor will bring his one-man "Macbeth to Broadway's Ethel Barrymore Theatre beginning April 7. It will run through June 30.

The production, which comes from the National Theatre of Scotland via the Lincoln Center Festival

The production, led by directors John Tiffany and Andrew Goldberg, originated at the National Theatre of Scotland and made a stop last summer in the Lincoln Center Festival.

In the play, "The Good Wife" actor appears as a patient in a white-tiled mental hospital for whom the plot of "Macbeth" is sort of a schizophrenic nightmare. Two other actors play medical staff, but speak few lines.

Tai chi is known as the stress manager. Often referred to as meditation in motion, the gentle movements and tranquility that the graceful art provides are unparalleled and unmatched by other forms of exercise. Tai chi was born in China and over the years has become a staple in aiding in improving health conditions such as diabetes.

Tai chi is a self-paced form of stretching that incorporates a series of movements that are slow in mannerism. Each movement performed flows into the next to ensure the body is continuously moving in a gentle fashion. There are many variations of tai chi depending upon the style which an individual is practicing, although its overall principle and emphasis is placed on movement. The focus of all tai chi is to promote wellbeing and to ease stress. The intensity of tai chi depends upon the individual?s preference as there are both fast and slow-paced forms of the anti-stress art form. Some forms of tai chi that may be suitable for some are not necessarily suitable for others.

Research as recently as 2008 showed that tai chi can improve blood sugar levels in type 2 diabetics. Two studies were performed by the British Journal of Sports Medicine in which they found that a 12 week program of tai chi had a significant effect in type 2 diabetics, specifically with their T cell activity. The levels of the type 2 diabetics? blood sugar levels fell from roughly 7.59% to 7.16% as long as the diabetic kept with the routine. Thus, it was concluded that participating in tai chi is definitely beneficial to type 2 diabetics given the amount of rigorous and vigorous, yet serene, movements associated with the exercise. The study also noted that when combined with Qigong, an energetic therapy, there were even more dramatic results in improved insulin resistance in type 2 diabetics? bodies. Many diabetics who participated in the tai chi study program also noted better sleep and a more vibrant, energetic feeling as well as better immune system responses. Tai chi has also been shown to relieve other forms of chronic pain, improve muscle flexibility and strength as well as relieving symptoms related to depression.

To get started with a tai chi program, there are many different options to take. There are books and DVDs about tai chi which detail the steps necessary to learn the principles behind the movements. There are also tai chi instructors, whose help is recommended especially to type 2 diabetics as they can educate clients on the underlying aspects of each technique and how it improves the effects of the disease on the body. There are often tai chi classes at senior centers, health clubs and fitness centers. Almost all tai chi classes run a period of 12 weeks, which allows a type 2 diabetic to see the benefits of the routine and movements. Individuals can always continue into more advanced sessions of tai chi to obtain a more centered and serene approach to life and overall energetic health.

Rocket carrying US satellite crashes into Pacific seconds after ...

A Ukrainian-made Zenith-3SL rocket carrying a US-made Intelsat-27 satellite has crashed into the ocean seconds after being launched from a platform in the Pacific Ocean. Ground control lost contact with the rocket.

Sea Launch, the company overseeing the launch, wrote in an official statement on their website that, "approximately 40 seconds after liftoff of the launch of the Intelsat 27 spacecraft, all telemetry was lost indicating a loss of mission."

The spacecraft, built by Boeing Satellite Systems, was launched on a Zenit-3SL launch vehicle on the ocean-based Odyssey launch platform at the Earth?s equator.

Preliminary reports suggested the rocket?s engines stopped automatically because its trajectory was incorrect.

?The first stage of the rocket was supposed to detach two-and-a-half minutes into the flight, but did not. A search operation is underway for the downed rocket.

The rocket?s flight was controlled remotely by a vessel six kilometers from the platform.

The Zenith rocket is joint project between Russian and Ukrainian space companies. The first two stages of the launch vehicle were designed and built in Ukraine, and the third stage is Russian-made.

The Intelsat-27 satellite, made by Boeing, was designed to transmit communication signals over the US and Europe.

The Odyssey floating platform is owned by the Sea Launch corporation. Previous launches at the platform have been successful. In April 2012, a similar Zenith-3SL rocket sent the Eutelsat W5A satellite into space.

Hagel emerges with solid Dem support for Pentagon

WASHINGTON (AP) ? Bruised and battered, Chuck Hagel emerged from his grueling confirmation hearing with solid Democratic support for his nomination to be President Barack Obama's next defense secretary and increasing Republican opposition to a former GOP colleague.

Mathematically, Hagel has the edge as he looks to succeed Defense Secretary Leon Panetta as the nation's 24th Pentagon chief, with Democrats holding a 14-12 advantage on the Senate Armed Services Committee.

That vote, which could come as early as next Thursday, looks increasingly like a straight party-line count as committee member and Republican Sen. Roy Blunt said Friday he will oppose the nomination.

"Senator Hagel's answers before the committee were simply too inconsistent, particularly as they related to Iran and Israel," said the Missouri lawmaker. "The idea that we can contain a nuclear Iran and his view that we should not have unilateral sanctions are just wrong and are too dangerous for us to try."

In fact, Hagel corrected his statement about containment of Iran and said all options, including military action, should be on the table to stop Iran from acquiring a nuclear weapon.

While Blunt announced his opposition, he signaled he would not support any effort to block the nomination, a looming question as Democrats have the votes to confirm Hagel in the full Senate but would need five GOP senators to end a filibuster.

Senate Armed Services Committee Chairman Carl Levin, D-Mich., expressed optimism about Hagel's prospects after nearly eight hours of testimony Thursday.

"I think his answers were honest and forthright and he did very well," Levin told reporters. "I hope that there will be some, who maybe were skeptical but who are undecided before this hearing, will maybe now look at him in a more favorable light. But I think there are a whole lot of folks who basically decided before the hearing that they were going to vote against him."

Hagel struggled at times as GOP senators hammered him on issues ranging from his support for Israel, opposition to Iran, stand on Hamas and Hezbollah and his backing for a group that advocates the elimination of nuclear weapons.

They repeatedly pressed him on past statements, votes and even letters he declined to sign. Refusing to show any frustration or anger, Hagel defended his record.

The former two-term Republican senator from Nebraska described his views as mainstream and closely aligned with those of Obama, the Democrat who nominated him. But several GOP members of the committee sought to portray him as radical and unsteady. Sen. Deb Fischer, R-Neb., called his ideas "extreme" and "far to the left" of Obama.

Hagel said he believes America "must engage ? not retreat ? in the world" and insisted that his record is consistent on that point.

He pointed to Iran and its nuclear ambitions as an example of an urgent national security threat that should be addressed first by attempting to establish dialogue with Iranian rulers, although he said he would not rule out using military force.

"I think we're always on higher ground in every way ? international law, domestic law, people of the world, people of the region to be with us on this ? if we have ... gone through every possibility to resolve this in a responsible, peaceful way, rather than going to war," he said.

He pushed back on the notion ? first raised by one of his harshest Republican critics, Sen. James Inhofe of Oklahoma ? that he favors a policy of appeasement.

"I think engagement is clearly in our interest," Hagel told Sen. Saxby Chambliss, R-Ga., who denounced the idea of negotiating with a "terrorist state."

"That's not negotiation," Hagel said. "Engagement is not appeasement. Engagement is not surrender."

The nominee's fiercest exchange came with Sen. John McCain, R-Ariz., a fellow Vietnam veteran and onetime close friend. Politics and Hagel's evolving opposition to the Iraq war caused a split between the two men that was on full display.

McCain suggested that Hagel and his critics were not quibbling over small matters.

"They are not reasonable people disagreeing; they are fundamental disagreements. Our concerns pertain to the quality of your professional judgment and your worldview on critical areas of national security," he said.

McCain pressed Hagel on whether he was right or wrong about his opposition to President George W. Bush's decision to send an extra 30,000 troops to Iraq in 2007 at a point when the war seemed in danger of being lost. Hagel, who voted to authorize military force in Iraq, later opposed the conflict, comparing it to Vietnam and arguing that it shifted the focus from Afghanistan.

"Were you right? Were you correct in your assessment?" McCain asked.

"I would defer to the judgment of history to sort that out," Hagel said as the two men talked over each other.

"The committee deserves your judgment as to whether you were right or wrong about the surge," McCain insisted.

Unable to elicit a simple response, McCain said the record should show that Hagel refused to answer. And he made it clear that he would have the final word ? with his vote, which he said would be influenced by Hagel's refusal to answer yes or no.

"I think history has already made a judgment about the surge, sir, and you're on the wrong side of it," he said.

Responding to criticism from outside GOP-leaning groups, Hagel repeated his regrets about using the term "Jewish lobby" to refer to pro-Israel groups. He said he should have used another term and should not have said those groups have intimidated members of the Senate into favoring actions contrary to U.S. interests.

"I'm sorry and I regret it," Hagel said. "On the use of 'intimidation,' I should have used 'influence,' I think would have been more appropriate."

At one point, Hagel mistakenly said the Obama policy toward Iran is "containment" even though the former senator has said all options, including military force, should be on the table. He was handed a note and corrected himself.

Hagel, 66, would be the lone Republican in Obama's Cabinet, the first Vietnam veteran to be defense secretary and the first enlisted man to take the post.

Russian court orders Pussy Riot videos be banned from Internet

MOSCOW (Reuters) - Russian punk rockers Pussy Riot on Wednesday lost an appeal against an Internet ban on their music videos, including one showing a protest song for which three band members were jailed.

A Moscow City Court upheld a lower court's November decision deeming the videos "extremist". Wednesday's ruling that meant that four Pussy Riot videos were banned from the web.

The videos were still available on sites hosted outside Russia, including the Google-owned YouTube.

The court rejected an appeal by one band member, Yekaterina Samutsevich, who said the ban violated freedom of speech.

"I think it's illegal - that is obvious," Samutsevich, 30, said outside the court. She said she would lodge a new appeal, but the ruling meant the videos must be removed from Russian websites.

Samutsevich and two bandmates were convicted of "hooliganism motivated by religious hatred" for their "punk prayer" - which called on the Virgin Mary to rid Russia of President Vladimir Putin - in Christ the Saviour cathedral, where the Russian Orthodox Church holds its main Easter and Christmas services.

She was freed in October when her sentence was suspended on appeal, but Nadezhda Tolokonnikova and Maria Alyokhina remain in prison.

The band said they were protesting the close ties between the government and the church, whose leader praised Putin during his successful campaign for a March 2012 presidential election.

The lower court judge said the videos contained "words and actions which humiliate various social groups based on their religion" as well as calls for mutiny and "mass disorder" and that they could ignite racial and religious hatred.

Kremlin critics called the jailing of Pussy Riot part of a drive to silence dissent and the United States and other Western countries called the punishment excessive.

Putin rejected the criticism, saying the feelings of Russian Orthodox and other believers must be protected.
